Terms and Conditions

 

Queensgate Shopping Centre has made a number of parking spaces available for Commuters.

Full Terms and Conditions for the use of the Queensgate car park are listed below:

 

  1. Car Parkers will only have access to the specified Car Park for the term agreed in writing. Payment of the appropriate fee entitles the Car Parker to One parking space in the specified Car Park only and for the relevant hours specific to that Car Park - Monday to Friday, unless otherwise notified by the landlord. After 09:30 hrs. Car Parkers are not guaranteed a parking space.

  2. The Car Park will open 05:30-23:30 hours Monday to Friday for commuter parking. Normal parking rates are applicable from Saturday and Sunday unless otherwise notified by the Landlord.

  3. Once the Car Park is closed for the evening, cars will not be available for release until that Car Park re-opens the following morning. (Late releases can be arranged i.e., for a train delay, but not on a continual basis, please arrange in advance by contacting Centre Management).

  4. All Queensgate Car Parks are closed on Easter Sunday, Christmas Day, and New Year’s Day.

  5. At peak trading times i.e., during the period prior to Christmas, we cannot legislate for the demand for parking in the Car Park. Please be mindful of this factor, especially in relation to your work hours and shift patterns (peak periods are not exclusively Christmas or January sale periods).

  6. The parking fee is subject to review at the landlord’s discretion and any fee reviews will be notified to parkers in writing from time to time

  7. Yearly parking paid in full prior to the commencement of the relevant Period – You cannot cancel the yearly parking at any time during the initial Period unless: (i) we have breached the agreement; (ii) you lose your job; (iii) you are diagnosed with an illness that renders you unable to work or you suffer from a medical condition that affects your ability to drive; or (iv) you move house or change your main place of work and, as a result, your Car Parking is no longer suitable. You must give us at least 14 days’ written notice of cancellation and we will require written evidence of your loss of employment, medical condition, or new address/work location (whichever is relevant). For renewal of your yearly parking, we will send you an email approximately 7 weeks before the start of the next Period. Your yearly parking will automatically renew and upon renewal you will be liable for the purchase price of yearly parking for the next Period. You must therefore notify us at least 28 days before the start of the next Period if you do not want your yearly parking to renew.  If your yearly parking automatically renews, you can cancel it at any time during that next Period by providing us with at least 60 days’ notice (except where you are only required to give a shorter notice period as set out above). We will refund to you an amount equal to the cost of the unused portion of your Season Ticket and such amount will be calculated as at the date of the expiry of the 60 days’ notice period. For example, if your yearly parking renews on 01 January and you notify us on 01 January that you want to cancel your yearly parking, your yearly parking will terminate on 01 March. We will refund you an amount equal to 10/12 of the purchase price of your Car Parking. Quarterly parking paid for in full prior to the commencement of the relevant Period – You cannot cancel the quarterly parking at any time during the initial Period unless: (i) we have breached the agreement; (ii) you lose your job; (iii) you are diagnosed with an illness that renders you unable to work or you suffer from a medical condition that affects your ability to drive; or (iv) you move house or change your primary place of work and, as a result, your Nominated Car Park is no longer suitable. You must give us at least 14 days’ written notice of cancellation and we will require written evidence of your loss of employment, medical condition, or new address/work location (whichever is relevant). For renewal of your quarterly parking, we will send you an email approximately 7  weeks before the start of the next Period. Our email will notify you that your quarterly parking will automatically renew, and you will be liable to pay for the price of quarterly parking for the next Period. You must notify us at least 28 days before the start of the next Period if you do not want your quarterly parking to renew. If your quarterly  parking automatically renews, you can cancel it at any time during that next Period by providing us with at least 28 days' notice (except where you are only required to give a shorter notice period as set out above). For example, if your quarterly parking renews on 01 January and you notify us on 01 January that you want to cancel your quarterly parking, your quarterly parking will terminate on 29 January. We will refund you an amount equal to 2 days and 2 months of the purchase price of your Car Parking. Monthly parking paid for in full prior to the commencement of the relevant Period – We will send you an email at least 21 days before the start of the next Period. Our email will notify you that your monthly parking will automatically renew, and you will be liable to pay for the price of monthly parking for the next Period. You must notify us at least 14 days before the start of the next Period if you do not want your monthly parking to automatically renew. If your monthly parking automatically renews, you will not be able to cancel it at any point during that subsequent Period and you will continue to be liable for purchase price of that subsequent Car Parking. You must therefore notify us at least 14 days before the expiry of the then current Period if you do not want your monthly parking to renew. Cancellation for breach We may also cancel the contract with you at any time without notice if you breach any of these Terms and Conditions, or if you misuse your car parking in any way.

  8. Payments can be made by Cheque and should be made payable to: Savills (UK) LTD and posted to: Queensgate Management Office, Queensgate Shopping Centre, Peterborough PE1 1NT. or Credit and Debit card payments are accepted at our Information Desk located on the Upper floor outside the O2 Store, or You can also pay directly into our bank account quoting your full name as the reference:

  9. The Car Park is for use only by the Registered User and the Vehicle Registration Number recorded on the ANPR database. It is not transferable. Any change in personal details or Vehicle Registration Number should be notified to the Management Office in writing, as soon as this occurs to avoid any risk of cancellation.

  10. Our car parks are for domestic vehicles only and the car parker should ensure their vehicle complies with the height restrictions set for that particular Car Park (6’ 10” or 2.1m)

  11. The Car Parker must not park their vehicle in a Parent & Child, Electric Charging Bays or Disabled designated space unless registered as a disabled driver, in which case a current Blue Badge must be always displayed in the vehicle whilst parked. Continual abuse of Parent & Child and Disabled designated bays may result in the Pass being withdrawn. The Pass holder must park within the lines of the parking bays.

  12. The landlord may decide not to reissue car parking and no reason will be given. The landlord or its representatives may terminate the agreement without notice if it believes there is any misuse, or any fees have remained unpaid.

  13. The landlord takes no responsibility for lack of access due to queuing or other traffic issues that are outside its control.

  14. Queensgate Shopping Centre is not obliged to accommodate use of our facilities in the event of matters beyond its control preventing access to the Car Park.

  15. Queensgate Shopping Centre reserves the right to close the Car Park for maintenance/safety reasons without notice and whilst endeavoring to provide alternative spaces is not obliged to do so.

  16. Vehicles and their contents are parked at the owner’s risk and the landlord will not accept liability for any loss or damage however caused.

  17. All information relating to parking, vehicles, and eligibility to park in Queensgate Car Parks is stored on computer record under appropriate data protection legislation.

  18. Although a space has been offered, and accepted by the registered user, there is no contractual obligation on the part of Queensgate Shopping Centre to continue this and the facility may be withdrawn at any time. However, should this be necessary we would endeavor to give the registered user as much written notice as possible.

  19. Please note Terms and Conditions are subject to change at any time.

  20. Privacy Statement: Please note that the information you provide us with is only used for billing and communication from us regarding Parking Facilities and changes to Terms and Conditions. We will never disclose your personal information to any third parties, except where we are required to do so by law. We maintain physical and  electronic safeguards in connection with the collection, storage, and disclosure of information. You can update or remove your personal details at any time by writing to management@queensgatecm.co.uk

  21. Refunds: Upon receipt of notice from you or notice by us that the contract with you will be cancelled, we will (if applicable) reimburse you by a payment into the account from which payment for the car parking was originally made or a nominated bank account, no alternative option is available, in respect of any amounts to which you are entitled. Any refund will be calculated in accordance with section 7 and will be based upon the unused portion of the relevant Period from the date upon which a valid notice of termination becomes effective, to the date upon which your car parking expires, or if earlier, the end of the Period for which payment has been made. No refunds will be issued for periods of 30 days or less to expiry/renewal. Refunds may take up to a minimum of 14 working days to be processed. Unfortunately, no refunds can be processed during the months of March, June, September, and December each year. Any refund requests received during these months will be processed in the following month. Any refunds due as result of an error by the Car Park Owner will not be subject to a minimum amount and will not be subject to an administration fee. You will not receive any refund where: (i) we cancel the contract as a result of your breach or misuse of your parking; (ii) where you or we cancel your parking which you pay for on a monthly or quarterly basis; or (iii) where, in the case of yearly parking, the unused portion of the then current yearly Period is less than 90 days.

  22. Circumstances beyond our reasonable control We reserve the right to defer delivery of your parking, or to cancel the contract with you, if we are prevented from or delayed in the carrying on of our business and our obligations under the contract due to circumstances beyond our reasonable control including, without limitation, acts of God, governmental actions, war or national emergency, riot, civil commotion, fire, explosion, flood, epidemic, lock-outs, strikes or other labour disputes, provided that, if the circumstances beyond our reasonable control continue for a continuous period in excess of 3 months, you shall be entitled to give notice in writing to us to cancel the contract.
